General Terms and Conditions of Sale

Article 1 - Purpose
These General Terms and Conditions of Sale (hereinafter referred to as the "GTCS") apply, without restriction or reservation, to all sales of Products (hereinafter referred to as the "Products") offered for sale on the website www.thegeorgiastore.fr (hereinafter referred to as the "Site") by the company The Georgia Store, a French limited liability company with a share capital of €15,000, registered with the Lyon Trade and Companies Register under number 995 190 204, whose registered office is located at 13 Place Maréchal Lyautey, 69006 Lyon (hereinafter referred to as the "Seller").
The Customer declares that they have read these GTCS and accepted them by checking the box provided for this purpose before initiating the online ordering process, as well as the General Terms and Conditions of Use of the Site.
These GTCS are in force until the publication of a new version.
The new GTCS will be applicable from the date of their publication on the Site, provided that the customer has been previously informed of their posting online.
The continuation of the relationship with the Company by the Customer after having been informed of the new GTCS will be considered as an acceptance thereof.
The new GTCS will also be applicable if the Customer has explicitly accepted them, regardless of the date of their publication.

Article 2 – Products
The Products refer to all items marketed by the Company, accessible for purchase via the Site or in-store, including clothing, accessories, jewelry, and other specific items.
The Products offered for sale on the Site are those that appear there on the day of consultation by the Customer, within the limits of available stocks.
The Products are described and presented with the greatest possible accuracy. However, if errors or omissions have occurred regarding this presentation, the Seller's liability cannot be incurred.
The photographs of the Products are not contractual.
Although every effort is made to ensure that the colors, materials, and patterns of the Products presented on the Site correspond faithfully to the originals, discrepancies may occur, particularly due to the technical limitations of the Customer's screens and computer devices. Thus, the Company cannot be held responsible for any minor differences or inaccuracies in the photographs
or graphic representations of the Products displayed on the Site.

Article 3 - Price
The prices of the Products are indicated in euros, all taxes included (TTC), excluding delivery costs.
The Seller reserves the right to modify its prices at any time, but the Products will be invoiced on the basis of the rates in force at the time of order validation.
Delivery costs will be indicated to the Customer before any payment.
For orders placed outside the European Union, prices are calculated and displayed on the Site with all local taxes and customs duties included automatically. Customs duties, local taxes, import duties, or state taxes are borne by the Seller. Upon receipt of the order, no additional fees will be requested from the Customer.

Article 4 - Ordering
Any order is firm and final. It implies unreserved adherence to these GTCS.
The Customer receives an acknowledgment of receipt of their order electronically. This acknowledgment of receipt constitutes acceptance of the order and forms the contract.
The Seller reserves the right to refuse any order for legitimate reasons and, more particularly, in the event that the quantities of Products ordered are abnormally high for buyers acting as consumers.
The Products presented on the Site are offered for sale within the limits of available stocks.
Thus, unless the order is definitively confirmed by the Company, it cannot guarantee the availability of the Products at any time nor ensure the maintenance of their price.
If a Product becomes out of stock after an order has been validated, the Company will inform the Customer as soon as possible, by email or telephone, and will proceed either to refund the order or to suggest an alternative Product available on the Site.
The Company reserves the possibility to modify the selection of Products offered on the Site at any time and without notice.
In order to guarantee optimal service and fair availability of the Products for all Customers, the Company may limit the number of items that can be purchased per Customer, in accordance with current regulations, in particular those of Article L.121-11 of the Consumer Code.
Furthermore, the Company reserves the right to refuse an order from a Customer involved in a dispute concerning a previous transaction, or if it considers, reasonably, that the Customer has breached the GTCS, engaged in fraudulent practices, or for any other legitimate reason.
The Customer has the possibility to sign up for a waiting list to be notified when a Product is back in stock. To do so, they must provide their contact details (title, last name, first name, email address) and consent to receive an email confirming the availability of the Product.

Article 5 - Payment
Payment is due immediately upon ordering.
The Customer may make payment by credit card, PayPal, or any other payment method offered on the Site.
Cards issued by banks domiciled outside of France must be international bank cards.
Secure online payment by credit card is carried out by our payment service provider. The information transmitted is encrypted according to state-of-the-art standards and cannot be read during its transport on the network.
Once payment is initiated by the Customer, the transaction is immediately debited after verification of the information.
In accordance with the provisions of the Monetary and Financial Code, the commitment to pay given by card is irrevocable.
By providing their bank details during the sale, the Customer authorizes the Seller to debit their card for the amount corresponding to the indicated price.
The Customer confirms that they are the legal holder of the card to be debited and that they are legally entitled to use it.
In the event of an error or inability to debit the card, the sale is immediately terminated by operation of law and the order is canceled.

Article 6 - Delivery
The Products ordered by the Customer are delivered to the address indicated during the order on the Site.
The Company delivers the Products in France and internationally exclusively via DHL.
The delivery times indicated on the Site are provided for information purposes only. Any potential delay will not give rise to damages, withholding, or cancellation of the order by the Customer.
For orders placed outside the European Union, prices are displayed with all local taxes and customs duties included. No additional fees will be requested from the Customer upon delivery.
The Customer is solely responsible for a delivery failure due to a lack of information or an error in the address provided during the order.
Upon receipt of the order, it is the Customer's responsibility to check the external condition of the packaging and to note any visible damage on the delivery slip.

In the event of a problem, the Customer must contact the carrier within three working days and inform the Company by email at: contact@thegeorgiastore.fr
If the delivery document is signed without reservation, no claim related to the condition of the package can be taken into account.
In the event of the recipient's absence, the package may be left at a relay point, rescheduled, or returned to the Company. The Company cannot be held responsible in the event of theft, loss, or deterioration in these situations.
If the package is returned to the Company due to a delivery failure, it will not be reshipped.
